Agreement to Terms

By downloading, installing, or using any application developed by Adrenaline App Dev ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our applications.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use our applications for personal, non-commercial purposes, subject to these terms and all applicable laws.

Acceptable Use

You agree to use our applications only for lawful purposes. You must not:

  • Use the app in any way that violates any applicable law or regulation
  • Attempt to reverse engineer, decompile, or disassemble the application
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the app to transmit any malicious code or harmful content
  • Attempt to gain unauthorized access to our systems or servers
  • Interfere with or disrupt the app's functionality or servers
  • Use the app for any commercial purpose without our written permission

Intellectual Property

All content, features, and functionality of our applications are owned by Adrenaline App Dev and are protected by international copyright, trademark, and other intellectual property laws.

User Content

Our applications do not require or request user accounts or user-generated content. Any data created within the app (such as alarms, settings, or preferences) remains local to your device and is your responsibility.

Third-Party Services

Our applications may integrate with third-party services such as:

  • Google AdMob (advertising)
  • Google Play Billing (in-app purchases)
  • Firebase (analytics and infrastructure)

Your use of these services is also governed by their respective terms of service.

In-App Purchases

If an application offers in-app purchases:

  • All purchases are processed through Google Play Billing
  • Purchases are final and non-refundable except as required by law
  • We reserve the right to modify or discontinue premium features at any time
  • Refund requests should be directed to Google Play Store support

Advertising

Some of our applications may display advertisements through Google AdMob. We do not control the content of these advertisements, but we strive to ensure they meet appropriate standards.

Disclaimers

AS-IS Basis

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation

No Guarantee

We do not guarantee that:

  • The app will meet your specific requirements
  • The app will be available at all times without interruption
  • The app will be free from bugs, errors, or security vulnerabilities
  • Any defects will be corrected

Alarm Clock Apps Disclaimer

IMPORTANT: If using an alarm clock application, while we strive for reliability, we cannot guarantee the alarm will function in all circumstances. Factors beyond our control (device battery, OS updates, app crashes, sound settings) may affect alarm functionality. Always have a backup alarm method for critical wake-up times.

Limitation of Liability

To the maximum extent permitted by law, Adrenaline App Dev shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the application
  • Any bugs, viruses, or harmful code transmitted through the application
  • Unauthorized access to or alteration of your data

This limitation applies regardless of the legal theory (contract, tort, negligence, etc.) and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold harmless Adrenaline App Dev from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the application
  • Your violation of these Terms of Service
  • Your violation of any rights of another party

Updates and Changes

We reserve the right to:

  • Modify, suspend, or discontinue any application or feature at any time
  • Update these Terms of Service at any time
  • Release updates, patches, or new versions with changes to functionality

Continued use of the application after changes constitutes acceptance of the updated terms.

Termination

We reserve the right to terminate or suspend your access to any application at any time, with or without cause, with or without notice.

Upon termination:

  • Your license to use the application immediately ends
  • You must uninstall the application from all devices
  • Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination

Privacy

Your use of our applications is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. Please review our Privacy Policy to understand our data practices.

Age Requirements

Our applications are suitable for all ages. If you are under 18 years of age, you should have parental permission to use our applications.

Governing Law

These Terms of Service are governed by applicable laws, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these terms or your use of our applications shall be resolved through:

  1. Good faith negotiation between the parties
  2. If unresolved, binding arbitration in accordance with applicable arbitration rules
  3. Each party bears their own costs unless otherwise awarded

Severability

Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Adrenaline App Dev regarding your use of our applications.

No Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.
